Commercial General Liability Insurance is the standard policy that most small businesses have in place in order to defend themselves against civil wrongs also known as torts. Care needs to be taken when obtaining business liability insurance quotes. There typically are nine intentional torts that are recognized within the legal system of the United States of America. Let’s explore these nine intentional torts and how they relate to the commercial general liability insurance.

Intentional torts against the person. These normally can include assault, battery, false imprisonment, and false arrest. The standard commercial general liability insurance policy typically does not provide coverage for these losses unless it is specifically endorsed onto the policy. When obtaining general liability insurance quotes make sure that this is an option.

Defamation. These are written statements that are made public that can damage the plaintiff’s reputation and/or asking in the community. Slander is another form of defamation which is done in an oral form publicly. Finally, libel is defamation that is put out in the public arena in a written format. These coverages can all be endorsed onto the insurance contract by the insurance company.

Invasion of privacy. This involves some violation of privacy specifically with regards to seclusion or the ability to be free from publicity. This potential loss too can be added to the liability policy. If you are a contractor the contractors liability insurance might also need to be extended to cover third parties.

Fraud. Fraud deals mainly with deceiving and/or deception of another party in trying to get the other party to part with their property in an illegal manner. Normally, this is not covered under the liability policy and is best covered under employee dishonesty bonds. Limited liability insurance is available on the standard policy.

Bad-faith. This is an outrageous breach of implied conduct of dealing with all parties concerned in a good faith and fair manner. Sometimes by expanding the contractual liability provision of the liability this coverage can be provided.

Business relationships interference. These losses arise out of intentional interference with business relationships with the intent to cause injury or harm. Sometimes these types of torts manifest themselves as false information, competition that will is unfair and/or illegal, interfering with a company or person’s employer, or interference with a trademark, patent, copyright and the like. Again these are specially coverage not normally covered under the liability policy but can be endorsed. If you own a restaurant and have restaurant liability insurance you might have specific coverage to protect you in this very competitive industry.

Legal process misuse. Usually this is described as Melissa’s prosecution. This involves filing frivolous lawsuits and the like. The specific typical loss is difficult to defend but with the broad and liability policy coverage is sometimes available. An online general liability insurance quote needs to be reviewed carefully to make sure you have this coverage.

Intentional torts against property. Usually is manifested in the form of a trespass on a person’s property and/or possession, or a conversion of another person’s property which in essence is theft. As was stated previously normally intentional acts are not covered under the liability policy but can be endorsed, this particular loss is problematic in finding coverage.

Nuisance. This can be a private nuisance or a public nuisance. The private nuisance involves some sort of interference with another private property’s owner’s constitutional right of enjoyment of their real property. The public nuisance usually affects a greater number of people and involves the local governmental to intervene in these offenses. The standard liability policy does not cover intentional torts to someone who is intentionally creating a nuisance probably will not be able to find coverage within their liability policy. Remember, getting free business general liability insurance quotes can be full of pitfalls if you don’t consider the source as being reliable and authoritative.

In conclusion, these nine intentional torts are usually not covered in the standard liability policy. For most of these intentional torts coverage can be enhanced or endorsed onto the liability policy. For those that cannot be covered under the liability policy there are special policies and/or bonds available to provide the coverage which is needed. Commercial General Liability Insurance and possibly a commercial insurance umbrella that has the proper endorsements may be all that you need to give you the peace of mind you are looking for.

Key components

In order to obtain a commercial insurance quote there are some specific items that need to be addressed.

Classifying your small business correctly is the first step in obtaining a commercial insurance quote. A detailed description of your products and services is important for the general liability classification process.

The next step in getting a business liability insurance quote is to determine the rating basis from which the premiums are promulgated. Some of the typical rating factors include:

square-footage of your small business

the annual gross payroll

the annual gross sales

number of employees

Another component of getting a commercial insurance quote is to assess the claims and losses. Insurance companies typically frown upon high-frequency or high severity claims potential. Most insurance companies are not looking to provide insurance for general liability claims that are frequent and severe.

Risk management and loss control are an important factor in getting a commercial insurance quote from insurance companies. The subjective part of the pricing for an insurance quote can be usually debited or credited up to 25% of the premium depends upon whether or not your small business has sound risk management practices in place.

If you as a small business owner will address these four steps in obtaining a commercial insurance quote, you will be well on your way to obtaining the best pricing possible. The first two steps are more objective while the last two steps are more subjective. Presenting your small business in the best possible light to the insurance companies will in turn provide you with the best possible commercial insurance quote from the insurance companies.

The Elements of Sound Decision Making for Obtaining Liability Quotes

This policy which serves as the basis for almost all small business insurance programs needs to be purchased with a few key elements in mind. The key elements of a public liability insurance quote are:

Education of the broker

Experience of the broker

Expertise of the broker

Ethics of the broker

Expanse of services and products from both the broker and the carrier.

Let’s look at how this plays out.

In getting a public liability insurance quote there are really two buying decisions. One is to decide which insurance company you are going to use and the second one is to decide which broker you are going to access the carrier through.

Education of the broker –

In the insurance industry there are several professional designations that available for a broker to obtain. A broker who is providing a public liability insurance quote should have the professional designation of CPCU (Chartered Property & Casualty Underwriter) or the ARM (Associate Risk Management). They two designations go through some 15 national exams on the subject matter of General Liability, Professional Liability, Small Business Liability, and Public Liability Insurance Quote.

Experience of the broker –

The years of experience of a broker are very important. Someone who is new in the business clearly does not have the experience to design the correct insurance portfolio for a small business.

Expertise of the broker –

A broker that has expertise in public liability insurance usually specializes in specific niches. As the insured it is prudent for you to look for a broker who specializes in your small business industry.

Ethics of the Broker –

While it is hard to judge the ethics of a broker, and insuring with a broker who has a professional designation means the broker has agreed to the professional designations standard of ethics.

Expanse of services and products –

Finally, it is important to know of the breadth and depth of the services and products that the broker can provide. The broker should have a variety of general liability and public liability insurance companies available for you to choose from.

*(This price is accurate for most businesses that are the primary office exposures with less than 1,500 square feet of office space, less than $150,000 in annual receipts and less than 10 employees)
Liability insurance for small business is a key building block in protecting the lively-hood of a small business.

Liability insurance covers negligent “tort” acts. Torts are civil wrongs. Liability insurance can also cover vicarious liability and contractual liability. Vicarious liability is created when someone acts on behalf of someone else. Sometimes this is referred to the doctrine of agency or principal. Contractual liability arises when by contract you have agreed to indemnify another party for your acts of negligence that have created a bodily injury or property damage.

What liability insurance does not cover are intentional acts or criminal acts.

Typically the liability insurance covers accidents that happen or occur on the premises. Coverage is also extended to cover your off premise operations and or services. If your small business sells a tangible product, coverage is provided from claims arising out of accidents from the use of your products.

Some of the more common coverages that you will seen in liability insurance specifically for small businesses is coverage for accidents and claims that create some kind of bodily injury or damages someone’s property. There is also coverage for slander which is defaming someone orally and for libel which is defaming someone in writing. The liability policy can also cover advertising injury, which can be very costly to defend without insurance for this type of claim. Large corporations and the competitors of small businesses are always looking for a way to bring a lawsuit against what they believe to be false advertising. As was stated earlier, intentional acts are not covered but unintentional false advertising would normally be covered under the liability insurance for small business.

As always, please review to your specific liability policy as coverages can be unique to your type of small business.
